These Terms of Service (“Terms”) govern your use of
powerhousetrailers.com and any purchases made from Power House Trailers
(“we”, “us”, “our”). By accessing our site or placing an order, you
agree to these Terms.

2. Eligibility
You must be at least 18 years old and legally able to enter contracts to
use this site or place orders. By using this site, you confirm you meet
these requirements.
3. Products and Pricing
– All prices are listed in U.S. dollars (USD).
– Prices exclude applicable sales tax, which is calculated at checkout
based on your shipping address. San Jose customers pay 9.375% (state +
Santa Clara County + city district).
– Prices exclude shipping/freight unless otherwise stated.
– We reserve the right to change prices at any time. The price displayed
at order confirmation is the price you will pay.
– Product images are representative; actual products may vary slightly
in color, finish, or hardware.
– All trailers comply with applicable Federal Motor Vehicle Safety
Standards (FMVSS) and ship with valid VIN numbers.
4. Orders and Payment
– Placing an order constitutes an offer to purchase. We may accept or
decline any order at our discretion.
– Accepted payment methods: Visa, Mastercard, American Express,
Discover, PayPal, and approved finance partners.
– Payment is processed at the time of order via Stripe and PayPal
(PCI-DSS compliant).
– We reserve the right to cancel orders involving suspected fraud,
pricing errors, or stock unavailability.
– A non-refundable deposit may be required for custom-built or
special-order trailers.
5. Shipping and Delivery
Shipping is governed by our Shipping Policy. We ship to the Continental
United States (Lower 48 states). Alaska, Hawaii, and U.S. territories
require custom quotes. Delivery timeframes are estimates only and not
guaranteed.
6. Returns and Refunds
Returns are governed by our Return Policy. In summary:
– 30-day return window from delivery date for most products.
– Items must be in original, resalable condition with all documentation.
– Return shipping costs are the buyer’s responsibility unless we shipped
the wrong item or it arrived damaged.
– Custom-built and special-order trailers are non-returnable.
7. Warranty
– Manufacturer warranties apply to all new trailers as provided by the
manufacturer.
– Used trailers are sold “as-is” unless otherwise stated in writing.
– Warranty claims must be processed through the original manufacturer.
– Our Limited Warranty terms are governed by the Magnuson-Moss Warranty
Act (15 U.S.C. § 2301).
8. Title and Registration
– New trailers ship with a Manufacturer’s Certificate of Origin
(MCO/MSO).
– Used trailers ship with a clean title (free of liens) unless stated
otherwise.
– Buyer is responsible for state title transfer, registration, and
registration fees with their local Department of Motor Vehicles (DMV).
– We provide all required documentation but cannot register the trailer
on your behalf.
9. User Account
– You are responsible for maintaining the confidentiality of your
account credentials.
– You must notify us immediately of unauthorized account access.
– You may not share, sell, or transfer your account.
– We may suspend or terminate accounts that violate these Terms.
10. Acceptable Use
You agree not to:
– Use the site for any unlawful purpose;
– Attempt to gain unauthorized access to systems or accounts;
– Interfere with site operation (DDoS, scraping, automated bots);
– Post false reviews or impersonate others;
– Resell or distribute our content without permission.
11. Intellectual Property
All site content (text, images, logos, product photos, design) is owned
by Power House Trailers or used under license. You may not reproduce,
distribute, or modify content without written permission.
12. Disclaimers
THE SITE AND PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY
KIND, EXCEPT AS REQUIRED BY LAW. WE DISCLAIM ALL IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE FULLEST
EXTENT PERMITTED BY LAW.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, POWER HOUSE TRAILERS’ TOTAL
LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE
SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING
RISE TO THE CLAIM.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL
DAMAGES.
Some states do not allow these limitations, so they may not fully apply
to you.
14. Indemnification
You agree to indemnify and hold harmless Power House Trailers, its
officers, employees, and affiliates from claims arising from your
violation of these Terms or misuse of products purchased.
15. Governing Law
These Terms are governed by the laws of the State of California, United
States, without regard to conflict of law principles. Any dispute shall
be resolved exclusively in the state or federal courts located in Santa
Clara County, California.
16. Dispute Resolution and Arbitration
Before initiating any legal action, you agree to first contact us to
attempt informal resolution. If unresolved within 60 days, disputes
shall be resolved through binding arbitration administered by the
American Arbitration Association (AAA) under its Consumer Arbitration
Rules, except either party may pursue claims in small claims court.
Class Action Waiver: All disputes shall be resolved on an individual
basis. You waive any right to participate in a class action.
17. Changes to These Terms
We may update these Terms periodically. Material changes will be posted
with a new “Last Updated” date. Continued use after changes constitutes
acceptance.
18. Severability
If any provision of these Terms is held invalid, the remaining
provisions remain in full effect.
